TERMS OF
SERVICE

Filmclusive Studio offers project-based services, which may include:

• Website design and refresh services
• Brand and visual identity work
• Photography and media creation
• Technical consulting and implementation
• Digital infrastructure setup
• Creative and production-adjacent services

All services are scoped in writing before work begins. Anything outside that scope requires written approval. No service is ongoing unless explicitly stated in writing.

Each engagement is limited to the agreed scope.

Timelines are estimates and depend on client responsiveness and access to materials, accounts, or third-party platforms.

Delivery occurs when final files, access, or deployments are provided. At that point, the project is considered complete.

Clients agree to:

• Provide accurate information and materials
• Confirm ownership or rights to all supplied content
• Supply access credentials where required
• Review deliverables promptly

Filmclusive Studio is not responsible for delays caused by incomplete, inaccurate, or late client input.

Projects include a defined revision allowance.

Additional revisions, feature requests, or scope changes require written approval, additional fees, and adjusted timelines.

Requests outside the original scope do not obligate Filmclusive Studio to proceed.

Payment terms are defined before work begins.

• Deposits are non-refundable once work starts
• Final payment is due upon delivery
• Late payments may pause work or delivery

Clients are responsible for fees charged by third-party payment providers unless otherwise stated.

Filmclusive Studio may rely on third-party services such as hosting, analytics, email, payment processors, or infrastructure tools.

Filmclusive Studio is not responsible for downtime, policy changes, data loss, or security issues originating from third parties.

Clients agree to comply with all third-party terms.

Websites and digital products are built using accessibility-aligned best practices available at the time of delivery.

Filmclusive Studio does not guarantee ADA or WCAG compliance, or regulatory/legal compliance. Ongoing responsibility remains with the client.

Upon full payment:

• Clients receive ownership of final, project-specific deliverables
• Filmclusive Studio retains ownership of pre-existing tools, systems, templates, and workflows
• Filmclusive Studio may display work for portfolio and promotional purposes unless otherwise agreed

Unpaid work remains the property of Filmclusive Studio.

To the maximum extent permitted by law, Filmclusive Studio is not liable for indirect, incidental, or consequential damages.

Total liability is limited to the amount paid for the specific service giving rise to the claim.

Either party may terminate an engagement in writing.

If termination occurs after work begins, completed work remains payable, deposits are non-refundable, and partial deliverables may be provided at our discretion.
